1. INTRODUCTION AND ACCEPTANCE

These Terms and Conditions ("Terms") govern your participation in the Digi Champ Olympiad ("Competition") organized by Clicknify ("Organizer"). By registering for the Competition, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must refrain from participating in the Competition.

2. ELIGIBILITY CRITERIA

2.1 Age Requirements

Participation in the Competition is open to individuals who meet the age requirements as determined by the Organizer. All Participants who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site. If any minor has visited the website and engaged into any transaction this will be deemed to be understood that she/he did such a transaction with the permission of her/his parents or guardian.

2.2 Exclusions

Employees, officers, directors, agents, and representatives of the Organizer, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and immediate family members of each are not eligible to participate in the Competition.

3. REGISTRATION PROCESS

3.1 Registration Requirements

Registration for the Competition must be completed through the official website www.clicknify.com . All information provided during registration must be accurate, complete, and up-to-date. The Organizer reserves the right to verify the eligibility of any participant at any time.

3.2 Registration Fee

The registration fee for the Competition is subject to the notification . All applicable taxes and transaction charges are included in this fee.

3.3 Refund Policy

Registration fees are NON-REFUNDABLE under any circumstances.

4. COMPETITION STRUCTURE AND RULES

4.1 Competition Format

The Competition will be held on the date as per the notification , commencing at the time at the designated venue provided in the notification. Participants must arrive at least 30 minutes before the scheduled start time along with valid identification.

4.2 Conduct During Competition

Participants must comply with all instructions provided by the Organizer during the Competition. Any form of cheating, plagiarism, or misconduct will result in immediate disqualification.

4.3 Prize Structure

The Competition offers the prize as per the notification to the winner(s). The Organizer reserves the right to modify the prize structure at its sole discretion prior to the commencement of the Competition.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Participant's Content

By participating in the Competition, you grant the Organizer a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display any content submitted by you during the Competition for promotional, educational, and documentation purposes.

5.2 Organizer's Content

All intellectual property rights in the Competition materials, including but not limited to questions, solutions, and evaluation criteria, remain the exclusive property of the Organizer. Participants are prohibited from copying, distributing, or using such materials without prior written consent from the Organizer.

6. DATA PROTECTION AND PRIVACY

6.1 Collection and Use of Personal Data

The Organizer will collect and process personal data in accordance with the Digital Personal Data Protection Act, 2023 and applicable rules. Personal data collected during registration will be used solely for the purposes of administering the Competition, communicating with participants, and as otherwise specified in the Organizer's Privacy Policy.

6.2 Minor's Data Protection

For Minor Participants, the Organizer shall implement additional safeguards in compliance with applicable laws. The processing of a Minor Participant's personal data shall be limited to what is necessary for their participation in the Competition.

6.3 Third-Party Sharing

The Organizer may share participant data with third-party service providers solely for the purpose of facilitating the Competition. Such third parties will be contractually bound to maintain the confidentiality and security of the data.

7. LIABILITY AND INDEMNIFICATION

7.1 Limitation of Liability

To the maximum extent permitted by law, the Organizer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with participation in the Competition. The Organizer's maximum aggregate liability shall not exceed the amount of the registration fee paid by the participant.

7.2 Indemnification

Participants agree to indemnify, defend, and hold harmless the Organizer, its officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to the participant's: (i) violation of these Terms; (ii) violation of any third-party right; or (iii) misconduct during the Competition.

7.3 Assumption of Risk

Participation in the Competition is voluntary. Participants acknowledge and assume all risks associated with their participation, including but not limited to personal injury, property damage, or data loss.

8. FORCE MAJEURE

The Organizer shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, civil unrest, terrorist attacks, or other similar events. In such circumstances, the Organizer reserves the right to reschedule, modify, or cancel the Competition.

9. MODIFICATIONS AND CANCELLATIONS

9.1 Modifications to Terms

The Organizer reserves the right to modify these Terms at any time without prior notice. Any modifications will be effective immediately upon posting on the official website. Continued participation in the Competition after such modifications constitutes acceptance of the modified Terms.

9.2 Competition Cancellation

The Organizer reserves the right to cancel, terminate, modify, or suspend the Competition at its sole discretion. In the event of cancellation by the Organizer, registered participants will receive a full refund of the registration fee.

10. DISPUTE RESOLUTION

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

10.2 Dispute Resolution Process

Any dispute arising out of or in connection with these Terms shall first be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiations within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

10.3 Jurisdiction

Subject to the arbitration clause above, the courts at Lucknow , India shall have exclusive jurisdiction over all matters relating to these Terms.

11. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

12. WAIVER

The failure of the Organizer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver by the Organizer of any breach of these Terms shall be a waiver of any preceding or succeeding breach.

13. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the participant and the Organizer regarding the Competition and supersede all prior agreements and understandings, whether written or oral.

Employees, officers, directors, agents, and representatives of the Organizer, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and immediate family members of each are not eligible to participate in the Competition.
